Europe Terms and Conditions

By making a deposit payment for your Classic Europe vacation, you acknowledge and agree to the terms and conditions set forth below.

Reservations: Contact your Travel Agent.

Payments: For all bookings made 45 days or more prior to departure, a deposit of $150 per person is required by Classic Custom Vacations ("Classic") within 7 days of making your reservation. If your deposit is not received by Classic within 7 days, your booking will be automatically canceled. Final payment is due 45 days prior to departure. Full payment is due immediately for bookings made within 45 days of departure. Hotels may require full payment at time of booking for high-demand periods. Villas and yachts require a 50% deposit at time of booking. Some published airfares may require full payment and immediate ticketing.

Prices: Prices are subject to change without notice. Prices are quoted per room/double occupancy and on an individual-component basis. All applicable taxes are included in the price of the vacation. Fees or other charges such as surcharges or taxes imposed by the airline after your vacation purchase (if any), however, will be your responsibility. Some airport departure fees may not be included and must be paid directly to the airline. Ask your Travel Agent about discounts and value-added specials.

Not Included: Gratuities, meals (except where otherwise noted), telephone calls, airport departure fees, resort fees, local driver's license, car seats, gas, parking, rental car overtime fees, some airport departure taxes, and any other items of a personal nature.

Price Guarantee: All bookings are price-protected upon receipt of deposit by Classic and purchase of Change & Cancellation Waiver (the "Waiver"), or when full payment is received for the entire booking prior to any price changes. Tax changes, surcharges and consumer-initiated changes are not price-protected.

Last-Minute Bookings: Classic accepts last-minute reservations, provided space is available and full payment has been received. There are no last-minute booking fees. Express-mail charges may apply.

Minimum Stays: The length of stay required varies by property, season and airline tariff. Your Travel Agent can obtain the details from Classic at the time of booking.

Forms of Payment: Payment may be made by agency check or by American Express, Diners Club, Discover Card, MasterCard, Optima, or Visa credit card. All returned checks are subject to a $35 service charge.

Protection of Funds: Classic is registered as a Seller of Travel with the Attorney General of the State of California pursuant to Section 17550 of the California Business and Professions Code, under registration #2029030-40. Registration as a seller of travel does not constitute approval by the State of California.

USTOA $1 Million Consumer Protection Plan: Classic Custom Vacations, as an Active Member of the United States Tour Operators Association ("USTOA"), is required to post $1 million with USTOA to be used to reimburse, in accordance with the terms and conditions of the USTOA Consumer Protection Plan, the advance payments of Classic Custom Vacations customers in the unlikely event of Classic Custom Vacations bankruptcy or insolvency. Complete details of the USTOA Consumer Protection Plan may be obtained by writing to 275 Madison Avenue, Suite 2014, NY, NY 10016 or by visiting the website at www.USTOA.com.

Change & Cancellation Fees: A handling fee of $50 per adult will be charged by Classic for all passenger-initiated changes or cancellations made after receipt of deposit. A fee of $100 per adult will be charged by Classic for all passenger-initiated changes or cancellations made after final payment is received by Classic. Hotels and condominiums may charge a fee for changes or cancellation. Villas may charge the full amount regardless of cancellation date. Airlines may charge significant change and cancellation fees which vary by carrier. Name changes will be treated as a cancellation and all cancellation fees will apply. Once travel has commenced, any changes or cancellation will be at the expense of the passenger unless a Change & Cancellation Waiver is purchased. To avoid these charges, ask for "Classic Europe's Change & Cancellation Waiver."

Change & Cancellation Waiver: For a fee you may change or cancel any part of your booking prior to travel for any reason without paying the normally assessed change and cancellation charges imposed by Classic, airlines, hotels or tour operators, unless otherwise noted. Some discounted, non-refundable or sale airfares are not covered by this Waiver. Private jet charters, yachts and some villas are not covered by this Waiver. The cost of a Change and Cancellation Waiver is $69 per adult passenger (18 years or older) for travel to Hawaii, the Caribbean, and Mexico ($99 per adult during Christmas and Easter travel). The cost of a Change and Cancellation Waiver is $79 per adult passenger (18 years or older) for travel in Europe, and $39 per adult passenger (18 years or older) for travel in the continental U.S.. Travelers 17 years of age and younger are covered at no cost when all adults in your traveling party purchase the Change and Cancellation Waiver. The Waiver must be purchased at time of booking. If you return early from your vacation, Classic Custom Vacations will refund all unused hotel and car rental components originally purchased through Classic Custom Vacations if minimum stay requirements are met. For refunds on special or weekly rates for accommodations and/or car rentals, the used portion will be charged at regular published daily rates. The Waiver does not cover no-shows, name changes, tax increases including fuel, airline and airport surcharges, lost or stolen tickets, client-initiated changes which result in fare or accommodation cost increases, air routing changes, or denied boarding as a result of inadequate travel documentation or late arrival. The Waiver is not refundable. When changing destinations after the Waiver has been purchased, the client is responsible for paying the difference (if any) in the new Waiver price. The Waiver is not insurance. No refunds are allowed on unused portions of airline tickets. Once travel has commenced, routing and/or class-of-service changes are not permitted. Classic Custom Vacations reserves the right to suspend offering and selling the Change and Cancellation Waiver at any time.

Refunds: Unused portions of airfare are non-refundable. Unused portions of your land package (e.g., hotel accommodations, car rentals, tours and activities) will not be refunded for any reason unless a Waiver has been purchased. For changes or cancellations prior to departure, Classic will remit a refund to you or your Travel Agent within 30 days, less the following:

a) Supplier charges for change or cancellation (which vary and may be significant).
b) Administrative charge by Classic for processing the change or cancellation (unless Waiver has been purchased).
c) Non-refundable airline tickets will not be refunded once ticketed.
d) Refundable airline tickets must be refunded before ticketed departure date.

Air Transportation: All airline tickets are purchased and issued on a round-trip basis. Departure fees are not included. No refunds are allowed on unused portions. Changes to flight itineraries may result in an increased airfare, a carrier-imposed charge or, in some instances, may not be permitted. Once travel has commenced, routing and/or class-of-service changes are not permitted. Additional cancellation fees are assessed by the airline on special fares. Classic passengers are subject to all airline limitations, liabilities and tariffs. All air carriers booked by Classic shall be liable only as common carriers to Classic passengers. Classic is not responsible for schedule changes or airline strikes. Some airport taxes are to be paid direct. Name changes not allowed. Classic is not responsible for multiple connections due to schedule changes.

Easter & Christmas Reservations: Various hotels, airlines, and condominiums have special cancellation, change, minimum night, and refund policies for stays during holiday peak-travel periods. These holiday policies are in addition to those stated on this page, will be described at time of booking, and will appear on your statement. Christmas: 12/15/05 - 1/05/06; Easter: 3/19/05 - 4/3/05. Deposits for Christmas and Easter bookings are non-refundable.

Entry Into Europe: To enter and leave Europe, all U.S. citizens must carry a valid passport. Non-U.S. citizens should check with their country's consulate. It is the responsibility of the traveler to determine the proper documents required by the government(s) of the destinations visited at time of travel. Please inquire with your Travel Agent. Classic will issue no refunds to passengers affected by their failure to provide proper documentation.

Family Plan: Many hotels and condominiums offer discounts for children when accompanied by full-paying adults. Maximum occupancy may vary when children on family-plan programs are included. Some hotels may not allow children or restrict children of certain ages. Some airlines offer children's rates.

Physical Disabilities: Any physical disability requiring special attention, treatment, or facilities must be communicated to Classic when the booking is made.

Rental Cars: Car-rental rates reflect unlimited mileage for a 24-hour rental period. Overtime fees are paid directly to the car company by client. Some locations may require a voucher. International driver's license fees are to be paid directly to the car company by client. No refunds will be made on car rentals of less than 24 hours. There will be drop charges assessed for car rentals returned to alternate car-rental stations, to be paid directly to the car company. The renter is responsible for paying directly to the car rental company all charges not covered by Classic's booking. Car-rental companies require that drivers possess a valid driver's license and major credit card or leave a cash deposit upon pick-up. Drivers must be at least 25 years of age. Additional drivers must be at least 25 years old. An additional-driver fee may apply and must be paid directly to the car company.

Bedding & Maximum Occupancy: Classic will request the bedding desired, although the requested bedding cannot be guaranteed. At some hotels and condominiums there may be an additional charge if a crib or rollaway is required. These charges are payable to the property upon check-out.

Documents: A personalized wallet is issued for each booking. Documents will be released upon receipt of full payment and mailed at least 21 days prior to departure. Documents may be requested earlier if full payment has been received by Classic. Airline tickets are issued with documents in accordance with air- carrier policies.

Classic, as the tour operator, is solely responsible for selecting the suppliers that provide the component parts (hotel accommodations, air transportation, transfers, car rentals, tours and activities, etc.) for the vacations described in this brochure. Classic does not own, control, or operate, nor is it an agent for any of the suppliers furnishing tour component parts. Therefore, in the absence of its negligence, Classic cannot be held liable for loss or damage to property or injury to persons caused by reason of any act or omission, intentional, negligent or otherwise by such third-party suppliers. In addition, Classic will not be liable for any delays, cancellations, strikes, government actions, force-major events or other causes beyond its direct control. Classic makes no implied or express warranties in the offering of any vacation described in this brochure. Classic will not be liable for any indirect, consequential or punitive damages. In no event will the liability of Classic or its affiliates exceed the amount paid for travel products booked or purchased from Classic.

General Provisions: This Agreement is governed by the laws of Washington. You hereby consent to the exclusive jurisdiction and venue of the courts in King County, Washington, for all disputes related to your travel from Classic. Classic reserves the right to cancel or alter any itinerary at its sole discretion. The information, rates, and terms and conditions contained in this brochure are accurate at time of printing and are subject to change without notice.
